1 Definitions

For the purposes of these Terms, the following definitions shall apply throughout:

2 Acceptance of Terms

By accessing the phataya Platform, creating an Account, or placing any wager or bet through phataya, you unequivocally confirm that:

• You have read, understood, and agree to be bound by these Terms in their entirety;
• You accept phataya's Privacy Policy, which is incorporated into these Terms by reference;
• You are of legal age to engage in online gambling in your jurisdiction of residence, and in any event are at least 21 years of age;
• You are not a resident of, or accessing the Platform from, a Restricted Territory;
• You are acting on your own behalf and not as agent, representative, or nominee of any third party.

3 Eligibility & Registration

To register for a phataya Account, you must meet all of the following eligibility requirements:

• Age: You must be at least 21 years of age. phataya strictly complies with the minimum gambling age requirements under Philippine law and PAGCOR regulations. Misrepresentation of age is a serious violation of these Terms.
• Legal Capacity: You must have full legal capacity to enter into a binding agreement under the laws of your jurisdiction.
• Geographic Eligibility: You must not be a resident of or physically located in a jurisdiction that prohibits participation in online gambling activities.
• Single Account: You must not already hold an existing phataya Account. One Account per person is strictly enforced. Accounts sharing the same IP address, device, postal address, payment method, or identity documents may be investigated for duplicate account violations.
• Not a Compulsive Gambler: You must not be a person who has self-excluded from any gambling service or been placed on any gambling exclusion register by a competent authority.

During registration, phataya requires you to provide accurate, complete, and current information including your full legal name, date of birth, Philippine residential address, email address, and mobile phone number. You are responsible for maintaining the accuracy of this information and must notify phataya promptly of any changes.

KYC Verification: phataya conducts identity verification (KYC) as a condition of withdrawal processing. You will be required to submit a valid Philippine government-issued identification document (e.g., Philippine Passport, SSS ID, PhilHealth ID, Unified Multi-Purpose ID, or Driver's License) and a selfie for liveness verification. Failure to complete KYC within the required timeframe may result in withdrawal suspension pending verification.

4 Account Management

You are solely responsible for maintaining the confidentiality and security of your phataya login credentials, including your password and any two-factor authentication (2FA) credentials. phataya will never ask you for your password under any circumstances.

• You must notify phataya immediately via our support channel upon becoming aware of any unauthorized access to or use of your Account.
• phataya shall not be liable for any loss or damage arising from your failure to maintain the confidentiality of your Account credentials.
• All activity conducted through your Account is your sole responsibility, whether or not authorized by you, unless you have notified phataya of a security compromise prior to the relevant activity.
• Sharing of Account credentials with any third party is strictly prohibited and constitutes a material breach of these Terms.
• Accounts that are inactive (no login and no transaction) for a period of twelve (12) consecutive months may be classified as dormant. phataya reserves the right to apply an inactivity fee of ₱200 per month to dormant accounts, provided that the Account balance will not be reduced below zero as a result of such fees.

5 Deposits & Withdrawals

5.1 Deposits. phataya accepts deposits via the payment methods listed on the Platform, including GCash, Maya, BPI, BDO, QR Ph, GrabPay, Coins.ph, 7-Eleven CLiQQ, and USDT TRC20. Minimum deposit amounts and processing times vary by payment method and are displayed in the Cashier section of your Account. Deposits are credited to your phataya Balance upon confirmation of receipt by phataya's payment processing systems.

5.2 Withdrawals. Withdrawal requests are processed subject to the following conditions:

• Your Account must be fully KYC-verified prior to withdrawal processing;
• There must be no pending wagering requirement on any portion of your Balance that would otherwise restrict withdrawal;
• The withdrawal amount must not exceed your available real-money Balance (Bonus Funds are not withdrawable until wagering requirements are satisfied);
• The minimum withdrawal amount is ₱500. Requests below this threshold will not be processed;
• Withdrawals will be returned to the same payment method used for the most recent deposit, unless otherwise approved by phataya's risk and compliance team.

5.3 Processing Times. phataya targets the following withdrawal processing timelines: GCash and Maya — within 30 minutes during standard operating hours; BPI/BDO bank transfer — within 1 business day; cryptocurrency — within 2 hours. These timelines are targets, not guarantees, and may be extended in circumstances requiring additional compliance review.

5.4 Currency. All transactions on phataya are denominated in Philippine Peso (PHP / ₱), except for USDT TRC20 transactions, which are subject to the prevailing exchange rate at the time of conversion.

6 Bonuses & Promotions

phataya offers various promotional bonuses from time to time, including welcome bonuses, deposit match bonuses, free spins, cashback, and loyalty rewards. All bonuses are subject to the following general terms, in addition to any promotion-specific terms communicated at the time of the offer:

• Wagering Requirements: Bonus Funds and free spin winnings are subject to wagering requirements before they become withdrawable. The applicable wagering requirement multiplier is stated in each promotion's terms. Failure to meet wagering requirements within the validity period will result in forfeiture of the remaining Bonus Funds.
• Game Contributions: Not all games contribute equally toward wagering requirements. Slots typically contribute 100%, while live casino and table games may contribute at reduced rates (commonly 10%–20%). Specific contribution rates are provided in each promotion's terms.
• Bonus Validity: Bonuses must be claimed and wagering requirements satisfied within the validity period specified. Unclaimed or unmet bonuses expire automatically.
• Abuse Prevention: phataya reserves the right to void bonuses and associated winnings, and to suspend Accounts, where evidence of bonus abuse is detected. This includes, without limitation, low-risk wagering strategies designed to satisfy wagering requirements with minimal variance.
• One Bonus at a Time: Unless stated otherwise, only one bonus may be active in a Player's Account at any given time.
• Max Bet Restriction: During an active bonus with pending wagering requirements, the maximum bet per round or spin is ₱500 unless the promotion's specific terms state otherwise. Bets exceeding this limit during an active bonus may result in forfeiture of the bonus and associated winnings.

7 Gameplay & Betting Rules

7.1 Game Availability. The availability of specific games on phataya may change over time. phataya reserves the right to withdraw, modify, or temporarily suspend any game without prior notice to Players. Bets placed before a game suspension are honored in the ordinary course.

7.2 Random Number Generation. All RNG-based games on phataya use independently certified random number generation systems provided by the respective game providers. phataya does not alter or influence the outcomes of any game.

7.3 Live Casino. Live dealer games are operated by third-party studio providers. Where a technical malfunction occurs during a live dealer game, the affected round may be voided and bets returned. The decision of phataya's game provider in such circumstances is final.

7.4 Sports Betting. Live sports betting odds are updated in real time and are subject to change prior to settlement. phataya reserves the right to void bets placed on events affected by obvious pricing errors. In-play bets that are placed after the relevant event's outcome is known (late bets) will be voided.

7.5 Malfunction Policy. In the event of a software, hardware, or connectivity malfunction that affects the integrity of a game session, phataya reserves the right to void the affected game round(s) and return the relevant wager(s) to the Player's Balance.

8 Prohibited Conduct

The following conduct is strictly prohibited on the phataya Platform. Violation of any prohibition in this Section constitutes a material breach of these Terms and may result in immediate Account suspension, forfeiture of Balance, and referral to law enforcement:

• Registering for or using the Platform while under 21 years of age;
• Maintaining more than one registered Account, whether under the same or different identity details;
• Providing false, misleading, or fraudulent information during registration or KYC verification;
• Using the Platform in furtherance of money laundering, terrorist financing, or any other financial crime;
• Engaging in collusion with other players to influence game outcomes;
• Using software, bots, scripts, artificial intelligence tools, or any automated means to place bets, exploit game mechanics, or circumvent platform security;
• Exploiting software errors, bugs, or vulnerabilities to gain an unfair advantage. Any winnings derived from such exploitation will be voided;
• Attempting to access or interfere with phataya's server infrastructure, security systems, or data;
• Reselling, transferring, or assigning your Account or any funds within it to any third party;
• Using a payment method that does not belong to you, or funding your Account with fraudulently obtained funds.

9 Intellectual Property

All content on the phataya Platform — including but not limited to the phataya name and logo, website design, graphics, software, game interfaces, text, and promotional materials — is the exclusive property of phataya or its licensors and is protected by applicable copyright, trademark, and intellectual property laws of the Philippines and international conventions.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial gaming purposes. You may not reproduce, distribute, modify, publicly display, create derivative works from, or commercially exploit any content from the phataya Platform without express written authorization from phataya.

10 Privacy & Data

phataya collects, processes, and stores personal data in accordance with its Privacy Policy, which is incorporated into these Terms by reference. By registering for a phataya Account, you consent to the collection and processing of your personal data as described in the Privacy Policy.

phataya complies with the Philippine Data Privacy Act of 2012 (RA 10173) and its implementing rules. You have the right to access, correct, and request deletion of your personal data held by phataya, subject to applicable legal retention requirements and our legitimate interests in maintaining transaction records for regulatory compliance.

11 Limitation of Liability

To the fullest extent permitted by applicable Philippine law:

• phataya provides the Platform on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement;
• phataya shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform;
• phataya's aggregate liability to any Player for any claim arising under or in connection with these Terms shall not exceed the amount deposited by that Player into their phataya Account in the thirty (30) days preceding the event giving rise to the claim;
• phataya is not responsible for telecommunications or internet service failures, platform outages caused by force majeure events, third-party payment processing delays, or any loss of data outside phataya's reasonable control.

Nothing in these Terms limits phataya's liability for death or personal injury caused by phataya's negligence, fraud, or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under applicable Philippine law.

12 Suspension & Termination

12.1 By phataya. phataya may suspend or permanently close your Account at any time with or without prior notice if:

• You are found to have violated any provision of these Terms;
• phataya has reason to believe that fraudulent or criminal activity is associated with your Account;
• phataya is required to do so by applicable law, regulation, or regulatory directive;
• Your Account has been the subject of a self-exclusion request.

12.2 By You. You may close your phataya Account at any time by contacting phataya's support team. Upon closure, any real-money Balance net of pending wagering requirements will be refunded to your registered payment method following successful KYC verification. Bonus Funds not subject to completed wagering requirements will be forfeited upon Account closure.

12.3 Self-Exclusion. Players who wish to self-exclude from phataya may request self-exclusion for periods of 30 days, 90 days, 180 days, or permanently. Self-exclusion requests are processed within 24 hours of submission. During a self-exclusion period, phataya will use reasonable efforts to prevent you from accessing the Platform.

13 Disputes

If you have a dispute with phataya, you must first contact our customer support team and attempt to resolve the matter in good faith. phataya will investigate and respond to all disputes within seven (7) business days of receipt.

If a dispute cannot be resolved through customer support, phataya operates an internal escalation process where disputes are reviewed by a senior compliance officer. The outcome of this review is final and binding on both parties, except where phataya has acted in manifest error or bad faith.

14 Governing Law

These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes), shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

You irrevocably submit to the exclusive jurisdiction of the courts of the Philippines to settle any dispute or claim that arises out of or in connection with these Terms or their subject matter or formation. Nothing in this clause shall limit phataya's right to seek urgent or interim relief in any court of competent jurisdiction.

15 Amendments

phataya reserves the right to amend, update, or replace these Terms at any time. Material changes will be communicated to registered Players via email or in-Platform notification at least seven (7) days prior to the effective date of the change, unless a shorter notice period is required by applicable law or regulatory directive.

Your continued use of the phataya Platform following the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not agree with an amendment, you must cease using the Platform and close your Account before the amendment takes effect.

The version of the Terms applicable to any transaction or event shall be the version in force at the time that transaction or event occurred.
